General Provisions
Nautical Center Trogir Ltd., located at Maksimirska Street 282, 10000 Zagreb (hereinafter referred to as the Organizer), is organizing the Dalmatia Boat Show (hereinafter referred to as the Show) at Marina Baotić, Seget Donji, Don Petra Špike 2a/Konacvine 15 (hereinafter referred to as the Marina), from April 10 to April 13, 2025. Interested parties are legal and natural persons who, in accordance with the General Terms and Conditions, complete the Application Form to participate in the Dalmatia Boat Show, for which the Organizer has not yet made a decision. Exhibitors are legal and natural persons who, in accordance with the General Terms and Conditions, participate in the Dalmatia Boat Show.
Applications and Participation
All legal and natural persons from the Republic of Croatia and abroad are eligible to participate in the Dalmatia Boat Show 2025 provided they duly and timely complete the Application Form, which also serves as the Exhibition Contract. By submitting the Application Form, the Exhibitor confirms participation in the Show and accepts all terms and prices set by the Organizer. The Application Form/Contract for Exhibitors must be submitted to the Organizer no later than December 1, 2024. The Organizer reserves the right to decide on the acceptance or rejection of each individual Application Form and to inform the Interested Parties of its decision within 10 days of receiving the Application Form. Based on the accepted Application Forms/concluded Contracts, the Organizer will allocate the rented space within the Show venue. The Application Form/Contract for Exhibitors is irrevocable and binding for the Exhibitor. All applications for exhibiting pertain solely to the registered legal and natural persons. The registered Exhibitor is not authorized to sublet the assigned exhibition space to any other legal or natural person; should they do so, they will be excluded from the Show and charged double the participation fee. An Exhibitor cannot transfer the space to another legal or natural person without the Organizer’s consent. Exhibitors are required to submit a list of workers who will be working at the rented space during the Show, along with their contact phone numbers, to the Organizer no later than 5 days before the Show starts to facilitate communication.
Payment
The prices for the Show are based on the current price list of the Dalmatia Boat Show. If the Organizer accepts the Application Form/Contract for Exhibitors, an Offer will be sent detailing all selected services along with the total price and payment information. The Exhibitor is required to pay for all services no later than 7 days from the date of receipt of the Offer. Offers and/or invoices are sent exclusively via email to the address provided by the Exhibitor when completing the Application Form. All participation invoices issued by the Dalmatia Boat Show must be settled by the due date. Invoices for additional services or deliveries that are ordered separately are due on the date of issuance.
Exhibition Space
The Organizer undertakes to provide the exhibition space and any ordered equipment no later than 24 hours before the start of the Show. The Exhibitor must bring all exhibition items to the venue at least 18 hours before the Show opens. Boats can be delivered no earlier than 72 hours before the start of the Show and must be removed no later than 72 hours after the Show ends. If the Exhibitor, for any reason, is unable to meet the deadline, they may request an extension in writing from the Organizer, who will decide on the matter and notify the Exhibitor accordingly.
The Exhibitor is allowed to arrange their exhibition space themselves, but must adhere to the required standards and applicable regulations. Exhibitors and visitors to the Show must comply with the Port Rules of Marina Baotić, which form an integral part of these General Terms and Conditions, as well as the General Terms of Business of Marina Baotić. Exhibitors must manage their waste in accordance with the Waste Reception and Handling Plan for ships and must take care to respect the Marina’s premises and all items located within it.
The use of open flames, liquid gas, welding equipment, and spark-generating machinery is strictly prohibited. Smoking is generally prohibited in exhibition spaces and pagodas. The Show Organizer provides cleaning for the exhibition area, conference tent, and walkways. Exhibitors are responsible for cleaning their stands, which must be done daily before the start of each day of the Show. If the Exhibitor does not have their own cleaning staff, only companies authorized by the Show Organizer may perform the cleaning. After the Show, the Exhibitor is obligated to return the space and any additional equipment to the Organizer in the condition in which they were received. Otherwise, the Organizer has the right to remove and store the items at the Exhibitor’s expense. The Exhibitor is responsible for covering any damages they may cause.
The Exhibitor must collect their exhibited items within 72 hours of the closing of the Show. If the exhibited items are not collected within this period, the Organizer is entitled to charge the Exhibitor a fee according to the valid daily berth rate until the invoice is paid in full, in accordance with the Organizer’s current Price List.
The contractual parties agree that the Organizer acquires the right to retain the boats with all accessories, as well as a lien (maritime privilege) on the boats for any unpaid claims. The right of retention remains until full settlement of the claims. If the Exhibitor does not settle the debt within 90 days from the due date, the Organizer will initiate a forced collection procedure for their claim.
Under the lien (maritime privilege), the Organizer is authorized to impose a temporary measure of arresting the vessel in connection with a claim that has arisen, to secure such a claim, regardless of ownership.
The Organizer holds a lien on the exhibited items of the Exhibitor, which may be subject to enforcement and can retain them until the claims are settled.
As a creditor of a due claim, in whose possession the exhibited items of the Exhibitor are, the Organizer has the right to retain the items until the claim is fulfilled.
Promotion and Sales at the Exhibition Space
In the exhibition space, the Exhibitor is entitled to display only the items for which they are the manufacturer or an authorized representative and to promote partners for whom they are an authorized representative. If the Exhibitor is unable to prove authorization to sell the products and services listed in the Application, the Organizer reserves the right to prohibit the exhibition of such products and services at the Show. The Exhibitor may display only the equipment and products specified in the Application Form, strictly adhering to the provisions of the Application Form/Exhibition Contract, with the obligation to submit for approval to the Organizer, by no later than March 1, 2025, a list of services they intend to provide and exhibits they intend to display.
The right to approve any activities within the premises during the Show (such as the arrangement of exhibition counters, catering, sales, filming, etc.) belongs exclusively to the Organizer. The Exhibitor is required to carry out the sale of products listed in the Application Form/Contract for Exhibitors in accordance with regulations and is responsible for ensuring that all displayed products comply with the regulations and standards of the Republic of Croatia and the EU. For any non-compliant products, the Exhibitor is obligated to inform visitors in writing. Any activity by the Exhibitor that disrupts other Exhibitors or visitors, as well as any form of political or propaganda activity, is strictly prohibited.
Fair Opening Hours
The Show’s opening hours for visitors are from 10:00 AM to 6:00 PM on April 10 and April 13, and from 10:00 AM to 7:00 PM on April 11 and April 12. The Exhibitor is required to display the registered exhibits from the opening to the closing of the Show, with a responsible person continuously present at the exhibition space—booth.
Vehicle Traffic
During the Show, a general parking ban is in effect within the exhibition area. Exhibitors are allowed access to the premises only with a valid exhibitor pass from 7:00 AM to 9:30 AM and after 7:00 PM during the Show. The Exhibitor expressly agrees that the interior of their vehicle may be inspected at any time by a Dalmatia Boat Show staff member or their representatives, under the supervision of the Exhibitor or an authorized person designated by the Exhibitor.
Responsibility and Insurance
The Organizer is not liable for any damages or losses that may occur to boats, boat equipment, other exhibits, or personal belongings for any reason. The Exhibitor is responsible for any damages incurred by the Organizer or third parties due to the use or possession of boats or other exhibits. The Exhibitor is required to insure their boats or exhibits for liability with an insurance company and must provide their own security for their property. Exhibitors displaying boats and marine equipment in the water must ensure that an authorized person, trained to operate these boats or equipment, is present even outside of the Show’s operating hours. Therefore, any damage to all exhibition exhibits is the sole responsibility of the Exhibitor. The Organizer accepts no responsibility for inaccurate entries in the official Show catalog or other types of Show publications (printing errors, formal errors, etc.). The Organizer does not accept shipments intended for the Exhibitor and is not responsible for any losses, incorrect deliveries, or delays.
Departure/Testing
Testing, trial, and demonstration rides within or outside the premises and waters of the Marina are permitted only during the operating hours of the Show. For the safety of people, exhibited items, and equipment, the Organizer reserves the right to temporarily prohibit departures or temporarily store exhibited equipment if unforeseen circumstances or adverse weather conditions require it.
Possible Changes in Dates
The Organizer commits to promptly informing Exhibitors of any relevant changes in the organization of the Show due to unforeseen circumstances. Exhibitors cannot claim compensation from the Organizer for such changes.
Cancellation of Participation
In the event of an Exhibitor’s cancellation of participation, the Organizer retains 100% of the amount stated in the offer.
Cancellation of the Event
The Organizer is obligated to deliver the contracted services to the Exhibitor at the event. If the Organizer is unable to hold the event due to its cancellation, the Organizer will refund 100% of the paid funds to the Exhibitors’ accounts. Exhibitors are not entitled to claim compensation for additional expenses or damages that may arise due to the cancellation of the event, nor is the Organizer obliged to reimburse them.
Accreditations - Official Passes
The rules for issuing and using official accreditations are set by the Organizer, who will inform the Exhibitor in a timely manner. The number of accreditations depends on the size of the rented space. An official pass is issued in the name of the person accredited by the Exhibitor, who is the only authorized user. The Exhibitor must complete a request for accreditation and submit it to the Organizer no later than March 15, 2025. If the request is submitted late, the Organizer reserves the right to charge for the production of accreditations according to the current price list. In case of accreditation misuse, the Organizer may refuse to provide services, and the person who misused it will be permanently removed from the Show.
Photos, Audio, Video Recordings, and Promotional Material
During the Show, the Organizer is authorized to freely photograph and create other types of video and audio recordings within the provided exhibition spaces and use them for their own and general purposes. In this regard, Exhibitors waive any copyright claims, and they are not authorized to make such recordings without the Organizer’s special approval, except within their own exhibition space. If the Organizer grants special approval, Exhibitors are required to display the name of the Dalmatia Boat Show. Exhibitors are allowed to make their promotional material available to visitors only within the space they have rented; otherwise, the Organizer will confiscate and remove all promotional material found outside their booth.
Breach of Obligations
Violation of any rule from these General Terms and Conditions grants the Organizer the right to terminate the Contract without the possibility of a refund or complaint.
Final Provisions
These General Terms and Conditions are drafted in Croatian and English, and in the event of any dispute, ambiguity regarding interpretation, or application of any of its provisions, the Croatian version shall prevail. In the case of disputes arising from violations or misinterpretations of the provisions of the General Terms and Conditions, application/contract, application form, etc., the Organizer and the Exhibitor mutually agree to the jurisdiction of the Commercial Court in Zagreb. The applicable law is the law of the Republic of Croatia. The Organizer reserves the right to amend or supplement the General Terms and Conditions of business at any time, as well as the right to modify, supplement, or discontinue any part of its business at any time without prior notice. Changes take effect on the date of publication. The Organizer is obligated to inform Interested Parties and Exhibitors of any amendments or supplements to the General Terms and Conditions of business via the email address provided in the Application Form.
Privacy Policy
Requests for the deletion and restriction of the processing of personal data can be made via email to: marketing@marinabaotic.com or in writing to: Don Petra Špike 2a, 21218 Seget Donji, Republic of Croatia, with the note: “for the Data Protection Officer.” Objections to the processing of personal data can be expressed and withdrawn at any time, and individuals may request the cessation of further processing of their personal data.
